Spousal support is the money one spouse pays to the other for maintenance and support while they are separated and during and after a dissolution. It is most commonly known as "alimony."
There are two types of spousal support:
• Pendente lite or temporary support, which may be awarded during the dissolution process; and
• Permanent support, which becomes effective when the divorce is final.
Determining the length and amount of permanent spousal support can be tricky and prompt feelings of anger and resentment. In addition, there are tax implications and consequences that may alter the bottom line. There is not a magic formula for determining permanent spousal support.
California has developed factors to be considered when awarding permanent support. However, the final amount and duration of support is largely based on how the court applies these factors to your situation. Because support is so important and because there is no magic answer, you need someone who understands how the court decides and applies these factors.
